Before the commencement of an investigation against a government employee in the case of corruption, the Supreme Court asked the Center's response to the petition seeking pre-sanction to challenge the Constitutional validity of the provision of Corruption Act to pre-approval. A bench of Chief Justice Ranjan Gogoi and Justice Ajay Rastogi issued notice to the Center on PIL filed by NGO, 'Center for Public Interest Litigation' (CPIL) against the validity of revised Section 17A of the Prevention of Corruption Act. Prashant Bhushan, representing the NGO, said that the revised provision gives pre-approval for the appointment of the necessary authority to initiate an investigation against government employees in cases of corruption. The Bench said, "We think you are entitled to hear and therefore we have issued notice."
