HC: Illegal Encroachments Need To Be Dealt With

In response to a Public Interest Litigation (PIL) filed by a South Delhi based Resident Welfare Association with regard to illegal encroachment, a bench consisting of Acting Chief Justice Gita Mittal and Justice C Hari Shankar, has issued a notice to the Centre, Delhi Government, South Delhi Municipal Corporation (SDMC) and the Delhi Police.

According to the PIL, there is a “once and for all” action required against the issue of illegal encroachment and the practice of permitting shops on pavements. It alleged that the illegal shops on pavements were involved in selling tobacco products in prohibited areas under the Street Vendor Act and that the authorities have failed to consider the fundamental right of the pedestrians under the Constitution. In its oral remarks, the bench pointed out that there are “pavements on pavements, because of which these encroachers return”.
