HC Says Can't Use Govt Land As Burial Ground

In response to a Public Interest Litigation (PIL) challenging a sub-divisional magistrate's order to use government land in Uttam Nagar, West Delhi, as burial ground, the Delhi High Court (HC) held that "No person has any right to use any open land, especially government land, indiscriminately as a burial ground" and dismissed the Kabristan Intzamia Association's plea.

The ruling was carried out by a bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar. The NGO (Kabristan Intzamia Association) began using the government's land on the basis of a statement made by an MLA.The bench asked the local authorities to take strict action for violating the order which was passed in August 1,2017, by the sub-divisional magistrate in Dwarka, according to whom there was "no illegality" in the decision.
